These Terms of Use (“Terms”) govern your access to and use of the platform live.brascast.com (the “Platform”), operated by BRASCAST SERVIÇOS DE TRANSMISSÃO LTDA, CNPJ 15.294.932/0001-61 (“BrasCast”, “we”, “us”, or “our”).

By accessing or using the Platform, you agree to these Terms. If you do not agree, you must discontinue use immediately.

1. About the Platform

The Platform provides tools for configuring, scheduling, and transmitting live video streams to supported third-party services such as YouTube, Facebook, and other platforms.

We do not create, produce, edit, store, review, or monitor the content you stream.
BrasCast provides only the technical means to transmit content that you create and control.

2. User Responsibilities

You are solely responsible for:

• All content you upload, stream, publish, or transmit through the Platform
• Ensuring your content complies with all applicable laws and third-party policies
• Managing rights, licenses, permissions, and clearances for all streamed material
• Ensuring that no copyrighted material is used without authorization
• Following community guidelines and terms of YouTube, Facebook, or other integrated platforms

Any copyright claim, DMCA notice, strike, ban, removal, blocking, or legal action resulting from your content is your full responsibility.

3. Copyright & Intellectual Property

You affirm that you own, control, or have legal authorization to use all content transmitted through the Platform, including:

• Music, audio, sound effects
• Images, videos, animations
• Logos, trademarks, brands
• Games, broadcasts, or any audiovisual material
• Third-party assets or media of any kind

BrasCast is not responsible for:

• Copyright violations committed by users
• Unauthorized use of licensed material
• DMCA takedowns or claims from rights holders
• Strikes or penalties applied by YouTube, Facebook, or other platforms
• Loss of monetization, channel suspensions, account bans, or related consequences

You agree to indemnify and hold BrasCast harmless against any claims, damages, liabilities, or expenses arising from your content or your misuse of the Platform.

4. Prohibited Content

You agree not to transmit content that:

• Infringes copyrights or trademarks
• Is illegal under Brazilian or international law
• Contains hate speech, discrimination, or incitement to violence
• Contains pornography or explicit sexual content involving minors
• Promotes terrorism, criminal activity, or harmful conduct
• Violates the terms of third-party streaming platforms

BrasCast may, at its discretion, suspend or terminate access to users who violate these conditions.

5. Third-Party Services

The Platform integrates with third-party services such as YouTube and Facebook. When you use these integrations, you must comply with their respective terms, such as:

• YouTube Terms of Service
• Google Privacy Policy
• Facebook Platform Terms
• Any applicable streaming or community guidelines

BrasCast is not responsible for failures, restrictions, limitations, or actions taken by these third-party platforms.

6. Availability and System Changes

We do not guarantee uninterrupted access to the Platform. Maintenance, system updates, outages, or third-party failures may affect availability.

7. Limitation of Liability

To the maximum extent permitted by law, BrasCast is not liable for:

• Losses arising from user content or unlawful activities
• Account bans, penalties, or strikes on third-party platforms
• Streaming failure due to incorrect configurations or third-party outages
• Direct or indirect losses including revenue, reputation, or data
• Content removed or blocked by YouTube, Facebook, or other services

8. Termination

We may suspend or terminate your access if you violate these Terms or applicable local, national, or international laws.

9. Changes to These Terms

We may update these Terms at any time. The updated version will always reflect the “Last updated” date at the top.
